With the inceasing complexity of construction contracts, Mackenzie Partnership has created a new department to advise on these contracts. There are a number of available versions and revisions of numerous different standard forms of contract being prepared and used with heavy adaptation, including bolt on, additional clauses and provisions.
In this modern age, Clients are much more aware of the consequences of entering into contracts without carrying out risk assessments and taking advice.
Our new consultancy service carries out these risk assessments and advises on how to try to negotiate or to adapt the most onerous of the clauses.
The consultancy service also advises on how the courts are construing particular clauses. This service can be provided in conjunction with any of the other services offered by Mackenzie Partnership to review and consider the best forms of contract and to structure adaptations for use on any particular project.
Dispute Resolution
The wide ranging effect of the introduction of the Housing Grants, Construction and Regeneration Act 1996 (known as the Construction Act) has turned on its head the traditional dispute resolution methods of litigation and arbitration.
With over 140 court judgements concerning the Construction Act, the whole process of statutory adjudication, payment terms and conditions requires detailed knowledge.
The Dispute Resolution Consultancy Service guides Clients through all forms of dispute resolution, advising on the pros and cons and at all times trying to settle the dispute as economically as possible.
The service provides risk analysis and assessment. If any risk is assessed, the service will evaluate it and recommend without prejudice offers and negotiations to avoid formal dispute resolution procedures.
